END-USER LICENSE AGREEMENT
for OCTOM (One Click To Many)

Acceptance. Installing or using OCTOM ("Software") constitutes acceptance of this Agreement between you and SkarpTech LLC ("SkarpTech"). If you do not agree, do not install or use the Software.

License Grant. SkarpTech grants you a non-exclusive, non-transferable, revocable license to install and use one copy of the Software on devices you own or control solely for personal or internal business purposes.

Restrictions. You may not

  1. reverse-engineer, decompile, or disassemble the Software except as permitted by applicable law;
  2. sublicense, lease, lend, sell, or distribute the Software;
  3. remove or alter proprietary notices.

Open-Source Components. The Software uses open-source libraries distributed under their own licenses:

  • Portions of Qt 6 (LGPL v3) – copyright © The Qt Company Ltd. and others.
  • nlohmann/json – MIT license © Niels Lohmann.
  • SimpleIni – MIT license © Brody Fitzpatrick.

Copies of each license and source code are provided at https://www.skarptech.org/oss/qt6, https://www.skarptech.org/oss/json, and https://www.skarptech.org/oss/simpleini. Where the LGPL applies you may relink or replace the LGPL portions and obtain source code from the same URL.

Intellectual Property. OCTOM, related trademarks, and all custom icons are owned by SkarpTech. Open-source components remain the property of their respective authors.

Data Privacy & GDPR/CPPA Compliance.

  1. Controller: SkarpTech LLC.
  2. Purpose: functional telemetry (performance, crash logs) and optional analytics with your consent.
  3. Legal Basis: Art. 6 (1)(a) & (f) GDPR / Canadian Consumer Privacy Protection Act (CPPA).
  4. Transfers: Data may be processed in the United States under Standard Contractual Clauses.
  5. Rights: You may access, rectify, erase, restrict processing, or port your personal data, and lodge complaints with your supervisory authority. Contact privacy@skarptech.com.
  6. Retention: Telemetry is retained no longer than 24 months unless legally required.

Consumer Rights Notice.

  • Nothing in this Agreement limits statutory rights under EU Directive 2019/770 (digital content) or applicable Canadian provincial consumer-protection laws (including Quebec).
  • Warranty disclaimers and liability limitations apply only to the extent permitted by mandatory law.

Third-Party Services. Certain features may rely on third-party APIs; your use of those services is subject to their terms.

Disclaimer of Warranties. Except as required by mandatory law, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability. Except as required by mandatory law, TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKARPTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOST PROFITS OR LOST DATA, ARISING FROM THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF SKARPTECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL SKARPTECH'S TOTAL LIABILITY EXCEED THE AMOUNT PAID (IF ANY) FOR THE SOFTWARE.

Indemnification. Except as required by mandatory law, you agree to indemnify and hold SkarpTech harmless from any claim arising out of your breach of this Agreement or your unlawful use of the Software.

Termination. This Agreement terminates automatically if you violate its terms. Upon termination you must uninstall and destroy all copies of the Software.

Export Compliance. You represent that you are not located in a U.S.-embargoed country and will comply with U.S. export laws.

Governing Law & Venue. If you reside in the EEA or Switzerland, this Agreement is governed by Irish law and disputes are subject to the exclusive jurisdiction of the courts of Dublin, Ireland. If you reside in Canada, Ontario law applies and disputes are subject to the courts of Toronto, Ontario. Consumers may bring disputes in their country/province of residence where mandatory law so requires.

Severability. If any provision is held unenforceable, the remainder shall remain in effect.

Entire Agreement. This Agreement (including referenced open-source licenses and the Privacy Policy) constitutes the entire agreement between the parties regarding the Software.
