1. Introduction
Welcome to SkarpTech. These Terms of Service ("Terms") govern your use of the SkarpTech website ("Site") and software products, including but not limited to OCTOM ("Software"). By accessing our Site or purchasing, downloading, installing, or using our Software, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our Software.

2. Account Registration
2.1 To purchase and use our Software, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2.2 You must provide accurate, current, and complete information during registration and keep your account information updated.
2.3 You are solely responsible for any activity that occurs through your account and must notify us immediately of any unauthorized use of your account.

3. Software Licensing
3.1 License Grant: Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to use the Software in accordance with the specific End User License Agreement (EULA) applicable to your region (NA or EU).
3.2 License Restrictions: You may not:
- Reverse engineer, decompile, or disassemble the Software
- Remove any proprietary notices or labels on the Software
- Use the Software for any illegal purpose
- Transfer, sublicense, or provide the Software to any third party unless explicitly permitted in the EULA
- Use the Software in any manner that could damage, disable, overburden, or impair our services
3.3 License Verification: Our Software may include license verification mechanisms that communicate with our servers to validate your license. Offline licenses are available upon special arrangement as mentioned in our Q&A section.

4. Payments and Refunds
4.1 Pricing: All prices displayed on our Site are in the specified currency and are subject to change without notice.
4.2 Payment: We accept various payment methods as displayed on our checkout page. All payments must be made in advance before receiving access to the Software.
4.3 Refunds: Our refund policy is outlined in our separate Refund Policy document. Please review it before making a purchase.

5. Intellectual Property Rights
5.1 Ownership: The Software, including its code, design, structure, and all intellectual property rights therein, are owned by SkarpTech and are protected by copyright, trademark, and other laws.
5.2 Feedback: If you provide any suggestions, ideas, or feedback regarding our Software, we may use them without any obligation to compensate you.

6. Updates and Support
6.1 Updates: We may periodically provide updates to our Software. These updates may be automatic or require manual installation.
6.2 Support: Support is provided through our designated channels (currently GitHub support repository) as described in our Q&A section. Access to support is provided upon purchase of a license.

7. Limitation of Liability
7.1 Disclaimer: THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
7.2 Limitation: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKARPTECH BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE.

8. Termination
8.1 We may terminate or suspend your access to our Site or Software immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.
8.2 Upon termination, your right to use the Software will cease immediately.

9. Governing Law and Dispute Resolution
9.1 These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
9.2 Any dispute arising from these Terms shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

10. Changes to Terms
10.1 We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Effective Date" at the top.
10.2 Your continued use of the Site or Software after any changes indicates your acceptance of the new Terms.

11. Miscellaneous
11.1 Entire Agreement: These Terms, together with the Privacy Policy and applicable EULA, constitute the entire agreement between you and SkarpTech regarding the Site and Software.
11.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
11.3 No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
